Rule 38
Service Charge Determination Committee
:
(1) A Service Fee Determination Committee will be formed as follows to determine the rate of service fee to be paid by the consumer for using the service from the project developed and operated by the licensee:-
(a) Person appointed by the Government of Nepal – Chairman
(b) Representative, Committee – Member
(c) Representative, District Water Supply Office – Member
(d) The person designated by the Government of Nepal among the consumers - member
(e) Concerned water supplier – Member – Secretary
(2) While determining the rate of service charge, the committee as per sub-rule (1) will do it on the basis of the cost of the project, the method of operation of the structure, the type of service, the cost of maintenance, the number of consumers, the annual income reduction rate, appropriate benefits, changes in the price list, etc. br> (3) Notwithstanding anything written in sub-rules (1) and (2), the service fee to be paid by the consumer for using the service from the project developed and operated by the consumer organization or transferred by the Nepal Government in accordance with Section 11 of the Act shall be as determined by the relevant water supplier.
(4) When determining the service charge according to sub-rule (3), the water supplier shall determine the rate of service charge with the technical assistance of the District Water Supply Office regarding the costs incurred during the operation and maintenance of the project.

(4) When determining the service charge according to sub-rule (3), the water supplier shall determine the rate of service charge with the technical assistance of the District Water Supply Office regarding the costs incurred during the operation and maintenance of the project.
